Mum to fight
child custody
case in Turkey
A MOTHER'S dra-
matic flight from
Turkey with her
young daughter
may have been in
vain after London's
Court of Appeal
ordered her to
return for a custody
battle.
The English woman
from Ilford, who cannot
be named for legal
reasons, took the two-
year-old away on a ferry
to a Greek Island last
year, before flying back to
London.
She claims she has suf-
fered at the hands of her
estranged husband, who is a
Turkish national, and claims
he and his family kidnapped
the youngster during a visit
in 2008.
Earlier this year, the
father launched a legal chal-
lenge under the Hague
Convention, which
enshrines the international
ban on child abduction, with
his lawyers insisting any
custody hearings have to
take place in Turkey.
Richard Anelay QC, for
the father, told three senior
judges the girl was "habitu-
ally resident" in Turkey
when she was brought to
England by her mother, and
for that reason must return
home.
Backing those arguments,
Lord Justice Wilson, sitting
with Lord Justice Laws and
Mr Justice Coleridge, said
although the girl has a dual
heritage, she was born in
Turkey and her parents
divided their time equally
between England and
Turkey.
He added the Turkish
legal system is now "much
admired" by the courts of
England and Wales, and pre-
vious rulings in the case in
Turkey had not shown any
"bias" towards the father.
At a previous hearing in
Turkey, the courts had
awarded the mother tempo-
rary custody of the daughter,
granting the father regular
contact.
The court heard the moth-
er, who fought back tears
when she was told she must
return to Turkey, alleges she
has suffered at the hands of
her husband, who she is now
divorcing.
Following her flight from
Turkey, she took out an
injunction at Ilford County
Court after hearing her hus-
band was in London, amid
fears he would abduct their
daughter.
Lord Justice Wilson
upheld a Family Court rul-
ing by Mr Justice Moylan in
August in which he said the
mother must head back to
Turkey.

CONCERT IS HOOKED ON CLASSICS
CLASSICAL music filled the air at a concert after fundraising
efforts for mental health service users.
Michelle Summerbell, occupational therapist at North East
London Foundation Trust, Goodmayes Hospital, Barley Lane,
Goodmayes, said classical music plays a big part in classes and
workshops.
She said:"We were faced with the challenge to raise �1,000 to
put on the concert and everyone rose to the challenge."
Cash was raised through a series of events and was spent on
the entertainment and hiring minibuses to take people to and
from the concert at the hospital.
Redbridge Concern for Mental Health also contributed.
A donation was made to Redbridge Mayor Cllr Thomas
Chan's appeal for Redbridge Business Education Partnership and
Redbridge's branch of
theAlzheimer's Society.
The performance last
week came from charity,
Live Music Now.
Ms Summerbell said:
"Everyone thought it
was fantastic.The second
half of the show was like
the Last Night of the
Proms and everyone was
singing along."
